Terms of Service

These Terms of Service ("Terms") govern your use of FirstYes, operated by FirstYes ("we", "us", "our"). By using FirstYes you agree to these Terms. If you do not agree, do not use the service.

1. The Service

FirstYes is a B2B sales outreach platform that helps founders and sales teams generate personalised outreach, track pipeline, and book more meetings. The service includes AI-generated email and LinkedIn content, email sending via your connected inbox, pipeline tracking, and coaching features.

2. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organisation. FirstYes is intended for business-to-business use only.

3. Your Account

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access. We are not liable for losses caused by unauthorised use of your account.

4. Acceptable Use

You agree to use FirstYes only for lawful B2B outreach. You must not:

• Send spam or unsolicited bulk email in violation of applicable law (including CAN-SPAM, GDPR, India's IT Act).
• Use FirstYes to contact individuals who have opted out of communications.
• Attempt to reverse-engineer, scrape, or abuse the platform.
• Use the platform to harass, threaten, or deceive recipients.
• Impersonate another person or organisation.

You are solely responsible for the content of emails sent through FirstYes and for compliance with applicable anti-spam and data protection laws.

5. Email Sending and Connected Accounts

When you connect your Gmail or Outlook account, you authorise FirstYes to send emails from your account on your behalf. You remain responsible for all emails sent. You can revoke this access at any time from Settings or from your Google/Microsoft account settings.

6. AI-Generated Content

FirstYes uses AI (Anthropic Claude) to generate outreach content, proposals, and coaching summaries. AI-generated content may contain inaccuracies. You are responsible for reviewing all content before sending it to prospects. We do not guarantee that AI-generated content will achieve any particular sales outcome.

7. Subscription and Payment

FirstYes is offered on a subscription basis. Pricing is displayed at the time of purchase. Subscriptions renew automatically unless cancelled. Refunds are available within 7 days of initial purchase if you have not sent any emails through the platform. No refunds are issued for partial subscription periods.

8. Intellectual Property

FirstYes and its original content, features, and functionality are owned by us and protected by copyright and other intellectual property laws. You retain ownership of all data and content you bring into the platform (contacts, company profiles, voice samples).

9. Limitation of Liability

To the maximum extent permitted by law, FirstYes is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages, including lost revenue or lost deals. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

You may cancel your account at any time from Settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted within 30 days unless required to be retained by law.

11. Changes to These Terms

We may update these Terms. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.
